General Data Protection Regulations (GDPR)

The deadline for implementation is fast approaching and most small businesses that I have come into contact with, either do not understand what it is or they are not sure what to do next. I invite you to a whistlestop tour of the key points, best resources to help and hopefully shed some light around what your business should do to prepare for the General Data Protection regulations. (GDPR)

Disclaimer: This blog post is not legal advice for your company to use in complying with EU data privacy laws like the GDPR. Instead, I aim to provide background information to help you better understand the GDPR.

What Is The GDPR And Will it Affect Me?

The EU defines ‘personal data’ as: ‘…any information relating to an individual, whether it relates to his or her private, professional or public life. It can be anything from a name, a photo, an email address, bank details, your posts on social networking websites, your medical information, or your computer’s
IP address’. The GDPR definition of ‘personal data’ is broader than under the DPA and includes IP addresses, device IDs, location data.
A typical use case may mean that if you attract people to your website and you want to collect data via a form you must communicate clearly to that person what the data is going to be used for. That individual then needs to give their consent for that use and the consent needs to be clear, in plain English and “informed, specific, unambiguous, and revocable“. Data subjects also need to be told about their right to withdraw consent.
In a nutshell even if the extent of your records are a name and an address for a previous order, GDPR rules will apply to you. Even after the UK leaves the EU similar rules will still apply. If you use third party suppliers to manage data e.g. Mailchimp, Constant Contact etc. You are responsible for checking these companies are compliant.

Typical small business uses of data that will need attention;

  • Email or Other Marketing Mailing Lists
  • Customer Records
  • CRM or Website Software Tracking apps (Ads or Analytics)
  • Job Applications

What Should I Do First?

Step 1

Start by considering what data you keep, where did it come from, why do you have it, do you still need it?  How should you secure it? This may mean seeking professional advice.

Step 2

A good source of information is the information commissioners office website. They have a telephone helpline specifically for small businesses 0303 123 1113

Step 3

Once you have established what is required of your business to comply, put the time aside and make an action plan to ensure compliance by the deadline.

As I find things that apply to my own business, I will gladly share the information with you, so we can learn along together on this one. I have already started to compile some videos and resources that I have found useful. You can find them below.  So keep checking back to this page and if you have found it useful share it. I have also left comments switched on for this post. (moderated to avoid spammers). So if anything changes, you find something brilliant to share or I have got it wrong please do let me know.

This 7 minute video is a recent one that I made to look at how email marketing has been impacted by GDPR.
